1. Acceptance of Terms

By accessing or using Carat Hunter ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.

These terms constitute a legally binding agreement between you and Digital Adventures Pty Ltd (ACN 697 144 531, ABN 93 697 144 531), trading as Carat Hunter. The Service is operated from Victoria, Australia. Use of the Service is subject to these terms and any mandatory local laws that apply in your jurisdiction.

2. Description of Service

Carat Hunter is a diamond price comparison platform. We aggregate publicly available pricing data from 100+ online diamond retailers worldwide to help consumers find the best deal on certified diamonds. We do not sell diamonds or facilitate transactions directly.

3. User Accounts

Account creation and authentication is managed through Supabase, a third-party authentication provider. By creating an account, you agree to provide accurate information and to keep your credentials secure.

You are responsible for all activity under your account. If you suspect unauthorised access, contact us immediately at [email protected].

If you request account deletion, we will remove your account data and associated chat transcripts. Some anonymised usage data may be retained for analytics purposes. Payment records may be retained as required by tax law.

4. Acceptable Use

You agree not to:

• Use automated tools, bots, scrapers, or scripts to access or extract data from the Service
• Reproduce, redistribute, or commercially exploit the Service's data, scores, or analysis without our prior written consent
• Interfere with or disrupt the Service's infrastructure or security measures
• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to any part of the Service
• Share your access credentials with third parties

We reserve the right to suspend or terminate your access if you violate these terms.

5. Payments & Refunds

Payments are processed securely by Paddle, our merchant of record. Carat Hunter does not store or have access to your payment card details or financial information.

Access passes are and do not auto-renew. There are no recurring subscriptions or hidden charges.

Refund Policy

We offer a from the date of purchase. To request a refund, you must:

• Contact us at [email protected] within 7 days of purchase
• Provide evidence that the platform did not work as expected (e.g. screenshots, description of the issue)
• Include brief feedback on what went wrong so we can improve

Refunds are issued at our discretion and processed back through Paddle. We are not obligated to issue refunds for dissatisfaction with diamond prices, market data, or AI-generated content, as these are informational outputs that vary over time.

6. AI Chat (Lucy)

Lucy is an AI diamond assistant powered by large language model technology. Lucy can search our database, compare diamonds, and provide general information about diamonds and the jewellery industry.

Lucy may produce inaccurate, incomplete, or outdated information. The underlying model has a training data cutoff and may not reflect the latest market conditions.

Chat transcripts are stored and may be reviewed for quality assurance and service improvement. If you are logged in, transcripts are linked to your account. You may request deletion of your transcripts at any time by contacting [email protected].

7. Pricing Information Disclaimer

Prices displayed on Carat Hunter are sourced from third-party retailers and are updated regularly. However, prices may change at any time without notice. Currency conversions are approximate and based on rates that may not reflect real-time exchange rates.

Carat Hunter is not responsible for pricing discrepancies, out-of-date listings, or changes in diamond availability.

8. Scoring & Analytics Disclaimer

The Caratlytics scoring system is a proprietary algorithmic assessment based on publicly available diamond specifications and market data. Scores are calculated using quality, value, certification, and market positioning metrics.

Scores, price trends, category analytics, and retailer analysis are provided for and should not be the sole basis for purchasing decisions. The scoring methodology and analytics may change over time as we refine our algorithms.

Past market patterns do not guarantee future outcomes. You should conduct your own research and, where appropriate, seek independent professional advice before making purchasing decisions.

9. Intellectual Property

All content, features, and functionality of the Service, including but not limited to the Caratlytics scoring system, market intelligence algorithms, user interface design, text, graphics, and software, are owned by Digital Adventures Pty Ltd (ACN 697 144 531) trading as Carat Hunter and protected by Australian and international copyright, trademark, and other intellectual property laws.

Diamond data sourced from third-party retailers remains the property of those retailers. Our aggregation, analysis, and scoring of that data constitutes original work.

10. Third-Party Links

The Service contains links to third-party retailer websites. These links are provided for your convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites.

Your interactions with third-party retailers, including purchases, returns, and disputes, are solely between you and the retailer. We are not a party to any such transactions.

11. Limitation of Liability

To the maximum extent permitted by applicable law, including the Australian Consumer Law, the total liability of Digital Adventures Pty Ltd (ACN 697 144 531) trading as Carat Hunter to you for any claims arising from or related to the Service shall not exceed AUD $50 (fifty Australian dollars).

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

Nothing in these terms excludes or limits liability that cannot be excluded under the Australian Consumer Law, including guarantees relating to the supply of services.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

We do not guarantee the accuracy, completeness, or timeliness of any pricing data, diamond specifications, scores, or market intelligence provided through the Service.

13. Indemnification

You agree to indemnify, defend, and hold harmless Digital Adventures Pty Ltd (ACN 697 144 531) trading as Carat Hunter, its directors, officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

Sections relating to intellectual property, limitation of liability, disclaimer of warranties, indemnification, and governing law shall survive termination.

15. Governing Law

These terms are governed by and construed in accordance with the laws of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria for any disputes arising from or relating to these terms or the Service.

Nothing in these terms limits any mandatory consumer protection rights that apply in your jurisdiction. Where you are located in a jurisdiction with mandatory local laws (including the EU, UK, Canada, or any other region we serve), those laws apply to the extent they cannot be excluded by agreement.

If you are in the EU or UK, you retain the right to bring proceedings in your local courts. If you are in Australia, nothing excludes or limits guarantees under the Australian Consumer Law.

16. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated terms.

17. AI Content Licensing

This section governs automated access to Carat Hunter, including scraping, crawling, and retrieval by AI assistants and answer engines. It supplements the rest of these Terms and does not override them where they conflict.

You may fetch Carat Hunter content for inference-time grounding of generative answers, provided every cited fact includes a clickable citation back to the source URL on Carat Hunter. This covers answer engines, retrieval-augmented generation systems, and any other inference-time use of our content.

Factual data, including diamond prices, specifications, certification records, and aggregate market statistics, is licensed under Creative Commons Attribution 4.0 International (CC BY 4.0) for training, fine-tuning, and embedding, subject to attribution. Attribution must include the phrase "Source: Carat Hunter" and a link back to the source URL.

Editorial content, including our diamond guides, glossary entries, weekly market pulse commentary, blog posts, and analytical commentary, is proprietary. It is not licensed for training, fine-tuning, embedding, or derivative dataset construction, even with attribution.

You may not construct a derivative dataset that reproduces our cross-retailer matching structure, diamond identifiers, Caratlytics Score values, or aggregate market analytics as a standalone data product. You may not bulk download the site and republish on a clone or mirror. You may not strip Carat Hunter attribution from cited content.

Programmatic access should use our public API. API access is rate-limited and requires an accurate User-Agent identifying your organisation. High-volume crawling of enumeration endpoints without identification may be throttled or blocked.

Carat Hunter expressly reserves the right to text and data mining in accordance with Article 4 of Directive 2019/790 of the European Parliament and of the Council. This reservation is declared machine-readable via the tdm-reservation meta tag on every page and in the machine-readable policy at /ai.txt. Complaints relating to unauthorised AI use, scraped clones, or attribution failures should be sent to [email protected].

18. Trademarks

"Carat Hunter" is a registered business name of Digital Adventures Pty Ltd (ACN 697 144 531) trading as Carat Hunter and is the subject of a trademark application lodged with IP Australia. The Carat Hunter wordmark, logo, and the "Caratlytics" scoring-system name are trademarks of Digital Adventures Pty Ltd (ACN 697 144 531) trading as Carat Hunter. Unauthorised use is prohibited.

All third-party trademarks, service marks, product names, retailer names, and grading-laboratory names (including but not limited to GIA, IGI, HRD, and retailer brand names referenced throughout the Service) are the property of their respective owners. Reference to these marks is for identification and comparison purposes only and does not imply any endorsement, sponsorship, or affiliation with those owners.

19. Our Independence

Our comparison results are editorially independent. We do not receive affiliate commissions, referral fees, or any other payment from the retailers listed on the Service. No retailer pays for placement, ranking, inclusion, or any favourable treatment in our results.

Our revenue comes from users who choose to purchase an access pass. This model is deliberate: we are paid by the people we work for, not by the retailers we compare. If this ever changes, we will disclose it prominently here and on the How We Rank page before any commercial relationships take effect.
